Penalties for cyber crimes: State and federal charges

Florida state penalties in cybercrime cases

When cybercrime charges are filed in Florida state courts, a conviction brings severe penalties. A case of online credit card fraud or intellectual property theft is a third-degree felony.

In a conviction, the penalties could include up to five years in state prison, five years on probation, and fines up to $5,000.

Second-degree felonies are punished even more severely, with sentences as high as 15 years in prison and fines up to $10,000. First-degree felony charges are filed against those believed to have hacked into a medical or treatment facility or any cybercrime that could endanger human health and life. The penalties in these cases include up to thirty years in state prison and fines of up to $10,000.

Federal penalties for cybercrime cases

Federal cyber crimes are covered under the CFAA, or “Computer Fraud and Abuse Act.” These crimes include obtaining national security information, hacking into a government agency computer system without authorization, selling passwords, phishing, unlawful access to stored information, sports betting, cyberstalking, drug trafficking over the internet, child pornography transmission, or the use of electronic communication in the commission of a fraudulent act, and many others. The penalties imposed at the federal level can include, in a first conviction:

  • Obtaining national security information: 10 to 20 years in federal prison.
  • Accessing a federal agency computer and obtaining information: 1 to 5 years.
  • Intentionally damaging a computer or network by intentional access: 1 to 5 years.
  • Conspiracy to commit one of these offenses: Up to 10 years in federal prison.
